Description:Excerpt from United States Circuit Court of Appeals for the Ninth Circuit: Ephraim Campbell, Appellant, Vs. Calvin M. Mangle, Jacob E. Tisher, Robert E. Norris and Charles W. Lehr, Appellees; Transcript of Record; Upon Appeal From the United States Circuit Court for the Southern District of California, Southern Division John F. Dostal, at Redlands, California, and who resides at Redlands, California, and who has been making and selling ume - gates embodying the said construction attempted to be patented in and by said Campbell patent, since 1899 and long prior to the al leged invention thereof by said Campbell, the ume gate so manufactured and sold by said John S. Dostal during the years 18199, 1900 and 1901 each contain ing and comprising a perforated plate having inbent edges, the perforation being between said edges, a tube inserted through the perforation and fastened to the plate and terminating in the plane near the plane in which the inbent edges lie and being beyond the plate, and a sliding gate or slide fitting between said tube end and said inbent edges, the same being substantially identical with the form shown in the drawings of said Campbell patent, except that the perforation in the plate was round in cross-section instead of being oval.
