Fol. 1081] is based on the action of the court in receiving in evi dence, over defendant's objection, a letter addressed to the Stoddard Incorporating Trust Company for the purpose of ascertaining what steps would be necessary to reduce the capital stock of the Panama Develop ment Company from one million dollars to one hun dred thousand dollars. The defendant objected to the introduction of this evidence and excepted to the action of the court in receiving it [tr. Fol. The fifth assignment of error [tr. Fol. 1082] was based on the action of the court in receiving in evi dence, over defendant's objection, a letter addressed to the Panama Development Company, advising said company of the necessary steps to be taken to legally change the articles of incorporation of an Arizona company.
