Description:Excerpt from Contested Election Case of Aaron P. Prioleau V. Richard S. Whaley From the First Congressional District of South Carolina Fourth. That 3,063 votes were cast for you, the Hon. W. H. Eberheart, the Socialist candidate, and myself in the aggregate, the consequence being that no valid election as required by Article I, section 2, of the United States Constitution was held in the first congressional district of South Carolina on November 3, 1914; that the sovereign power of the district expressed by the vote of the citizens therein was denied and restrained in violation of the Constitution of the United States; and contestant alleges and avers that no Representative from the first congressional district of South Carolina was elected in the Sixty-fourth Congress; that the irregularities, unlawful means, refusal and denial of citizenship rights under the laws of the State of South Carolina, enforced by you and your friends, have deprived the contestant of over 27,000 legal voters who tried and desired to vote for me as Representative in the Sixty-fourth Congress but were prevented by your Democratic friends and supporters. Wherefore the contestant alleges and avers that an honest, fair, and impartial administration of the registration laws, of the election, of the count, and the return of the votes cast and the votes that of right ought to have been cast, he were elected, but that the aggregate of 3,063 votes cast, counted, and returned for the three candidates, namely, you, the contestee, Hon. Eberheart, the Socialist, and myself, the contestant, at the election of November 3, 1914, did not constitute a valid election for Representative in the Sixty-fourth Congress under Article I, section 2, of the Constitution of the United States, and no Representative from the first congressional district of South Carolina has been elected, there being less than thirty thousand votes in the aggregate cast and counted for the candidates above named.
